According to recent news from The Reporter, the CEO of Jelly Belly, the famous candy company that produces the popular candy of the same name, has issued a public statement about a fatal tank accident that occurred on his privately owned property.

tank-series-3-1503813Authorities say a visitor was run over and killed by a military-style tank or armored vehicle on property owned by the candy company CEO. The accident is still under investigation. CEO Herman Rowland issued the statement, in which he said his entire family is still in a state of shock. He went on to say an invited guest of the family was there for a family reunion, when he “was involved in an off-road vehicle accident on private property.” He then went on to express many good qualities about the victim and how his loss has affected the family.

This off-road vehicle is not what one typically associates with the term, since authorities described it as a battle tank. Apparently, Rowland has been a long time collector of military vehicles, and this was one of the vehicles in his private collection. Authorities say one guest was given permission to take guests on rides around the property in the military vehicles if they so desired.

A 55-year-old guest of the family was riding on the tank, but was seated on the front of the vehicle and was not inside the passenger compartment. The tank went down a steep hill, causing victim to be thrown forward to the ground in the tank’s path, where he was run over by the steel treads propelling the tank. Someone called 911 immediately following the accident, but there was nothing that could have been done to save the victim, as he was killed as soon as he was run over by the tank.

Authorities say other family members who were at the house for the family reunion where in state of apparent shock and seemed inconsolable following the fatal accident. Rowland said his family would cooperate with the authorities and provide any needed assistance. It is important to note that nobody has been deemed negligent or otherwise responsible for this tragic accident at this time.

A traumatic brain injury can leave a victim with unimaginable consequences. A person who was once an intelligent and outgoing individual with a bright future may be left unable to perform even the most basic tasks learned during childhood.

photo_emerging_TBIVictims of a traumatic brain injury may also be forced to undergo numerous surgeries and years of physical and occupational therapy. Some people will be fortunate to regain most or even all of their mental and physical abilities, and others will never recover at all.

As our Boston traumatic brain injury (TBI) attorneys can explain, medical bills are often only the beginning. The cost in future medical bills and rehabilitation expenses can be seemingly limitless. This is made even worse by the fact that, in many cases, a family member will have to stop working, so he or she can take care of the victim full time, as many traumatic brain injury patients need assistance for even simple tasks.

However, these are examples of some of the worst instances of traumatic brain injury. There are many victims who have a TBI that leaves them with difficulty concentrating, painful headaches, vision problems, motor control problems, and other mental and physical problems, but they still fare much better than other TBI patients. These victims can function in society and take care of themselves, but may find it difficult to work or engage in social relationships to the extent possible before the accident.

According to a recent news feature from Medical News Today, there is now convincing evidence a traumatic brain injury can lead to attention hyperactivity deficit disorder (ADHD).   A Canadian study found links between adults with a brain injury and a history of ADHD. Research suggests brain injury patients may benefit from ADHD screening and treatment options.

A researcher quoted in the article said the link is significant and that patients who suffered a traumatic brain injury are more than two times more likely to develop ADHD than those who have not suffered a serious brain injury.   ADHD is described as a chronic impulse behavioral disorder and involves difficulty with sustaining attention.

This is not only significant by itself, but also when we consider the rate at which traumatic brain injury is increasing across the world. According to the World Health Organization (WHO), by the year 2020, traumatic brain injury will become the world’s third most frequent medical issue, behind heart disease and depression. The reason for this is not that more people are suffering head injuries than ever before, but that with modern medical advances, doctors are able to save more people who have suffered catastrophic injury.

For example, in the recent wars in Iraq and Afghanistan, we had more troops return from the battlefield with a traumatic brain injury than in previous conflicts. This is true even though hundreds of thousands more U.S. troops were killed in prior conflicts. The reason is because, in past years, many of these troops would have never made it off the battlefield; however, today, rescue workers are able to airlift them to Combat Support Hospital for immediate surgery and then airlift them to a regular military hospital for rehabilitation.   This is similar to accident victims who can now be saved, but may have lasting consequences in terms of TBI.

New York's Attorney General, Eric Schneiderman, unveiled a sweeping Fraud Control Unit designed to target healthcare providers who abuse the Medicaid system. According to the AG's website, they are continuing to add dozens of prosecutors and investigators to keep up with reports and investigations. Nursing homes throughout the country are largely paid by Medicaid funds. To stay profitable, nursing homes must remain at near full occupancy. This often means cutting corners, refusing to transfer residents who need critical care or higher levels of care, and even billing for services that are not (or cannot be) provided. Below are just three simple examples of Medicaid fraud in nursing homes.

Billing for Services Not Rendered

When a resident goes to a skilled nursing facility, the resident and his or her family typically sign a contract and apply for Medicaid. At times, the application takes some time to be approved, but once it is, the money begins flowing to the nursing home, paying for whatever services are billed. There are fairly strict rules on what the facility can bill for and how much they are paid.

Nursing homes are only paid a fraction of their regular charges. Say the actual room charge is $8,000 per month, Medicaid may pay only about $1,500 to $3,000. Usually it is only a small fraction. So, nursing homes do anything they can to ensure they get every penny. Some will bill for a private room, when in truth the resident shares a room with 4 other residents who themselves all pay for private room as well. Nursing homes may also report that a resident is receiving a gait belt to help with mobility or other assistive devices, when in reality such devices are being share among an entire floor of residents, each being billed as having the same expensive device.

Medications Not Being Administered

As horrible as it sounds, some nursing homes have even stooped so low as to report the administration of medications to residents when no such medications are given. The way this little scheme is done is the nursing home will "ration" meds by giving patients less critical medications every other day instead of daily. Or, perhaps that does that requires 3 times per day will become 2 times per day. When spread over time, they save a lot of medicine by again sharing the same medication across the population and yet still billing as though all patients received appropriate doses.

Physician Extenders Being Overused

In the past 10-15 years, we have seen a real surge in the use of nurse practitioners and physician's assistants. And for the most part this is a cost savings for the public. However, some nursing homes use these "physician extenders" to bill as though the physician had actually visited. To explain this a little better, each nursing home must have a medical director - a doctor who oversees care. That doctor does not typically stay on the premises but is required to visit and see patients at certain intervals, and he or she also consults with the nursing staff to ensure more critical issues are properly addressed. However, some facilities will allow the nurse practitioner to fax treatment records and orders to the physician, who in turn signs them without ever seeing the patient. Then, since the care appears to have been provided by a physician, Medicaid is billed at a different rate than if billed for just the nurse practitioner's bill was generated.

Given the recent attention paid to fraud by New York's Attorney General, nursing homes should be careful. When selecting a nursing home, be sure to do your homework and review state complaints and investigations. You can also discuss the decision with an elder law attorney to learn more about quality homes in your state.

According to a recent news article from CBS, the son-in-law of the famous reverend Billy Graham died in a tragic incident in a pool owned by the family. Family members say Danny Lotz, the 78-year-old victim, was swimming in the family pool when his heart stopped.

mtJBN8KHis wife Ann, Rev. Graham’s daughter, found her husband floating facedown in the water and immediately dialed 911. During the 911 call, victim’s wife said “He’s in the water. He’s huge. I can’t get him out. I’m just trying to hold his head above water.” Unfortunately, she was unable to get her husband out of the water.

When authorities arrived at the family home, they attempted to resuscitate victim and transported him to a local hospital where he was pronounced dead.   Family members stated victim had significant heart disease over the course of his life, and he had five stints in his arteries prior to his death. The couple had been married for 49 years at the time of victim’s death. Lotz played varsity basketball on the 1957 University of North Carolina men’s team. That year, UNC was undefeated in 32 games and won the national championship.

This holiday is the last chance for many to enjoy a day on the water. Whether you are planning to go to a neighborhood pool or are going to the beach, it is essential to be careful when in and around water. It is especially important to watch young children at all times when they are in or near the water. While many people think it is safe if the water is shallow enough for the kids to stand in, even adults have been known to drown in water that is two inches deep. If the water is deep enough to cover the nose and mouth of a victim lying facedown, it is deep enough to result in drowning.

It is also important to pay attention to how a child is acting after being in the water, especially if there was a close call. Even hours after a victim is pulled out of the water and appears to be okay, the balance of oxygen and water may be off, and this can result in what is referred to as dry drowning. In cases involving dry drowning, we see parents calling 911 after a child has passed out, and there is often very little doctors can do at this point. For this reason, it is essential to make sure paramedics check out your child if anything appears out of the ordinary.

Paramedics are trained to recognize symptoms of dry drowning and can listen to the victim’s airway and use a pulse/oxygen monitor to check chemical levels. If anything appears off at this point, the child should be taken to a hospital immediately.

Mitchell v. City of Warren, a case from the United States Court of Appeal for the Sixth Circuit, involved a rather unusual set of circumstances that resulted in the tragic death of plaintiff.

1235172_beeAccording to court records, an officer responded to a call for assistance to provide backup to another officer who was in the process of conducting a traffic stop. The first officer alleged plaintiff was driving with expired license plates when the officer initiated the traffic stop. The 16-year-old plaintiff then allegedly ran from his car and tried to hide in an abandoned house.

The second responding officer arrived as the first officer was attempting to secure plaintiff. At this point, there was a struggle between plaintiff and arresting officers, and second responding officer took out his police-issued taser and fired at plaintiff. As our Boston personal injury attorneys can explain, tasers work somewhat differently that most people are aware. The devices actually fire a barbed projectile, called a taser dart, that resembles a miniature harpoon or straightened fish hook. The dart has a barb at the end that is designed to go through clothing and pierce suspect’s skin, where it gets embedded. After being tased, paramedics often have to cut the barb off the dart in order to remove it from suspect. A taser fires two darts at the same time.

In this case, one dart hit plaintiff in his heart. The second dart hit plaintiff a few inches below his heart. Suspect fell to the ground and was nonresponsive. The taser current had stopped plaintiff’s heart. Police called an ambulance to the scene, but paramedics were unable to revive plaintiff, and he was pronounced dead on scene.

Victim’s family filed a lawsuit against the city, the officers, and the maker of the taser device. The city settled the other claims, and the lawsuit proceeded against the maker of the taser. As part of the discovery process, officers testified the manufacturer trained that the device was safe even if it was fired at a suspect’s chest.

The defendant filed a motion to dismiss the case, claiming, under Michigan law, there was no duty to warn a buyer of a risk after the product was sold, and there was no duty assumed by performing a training series. There was no proof the officer who fired at suspect would have ever seen a warning, had one been issued. Unfortunately for plaintiff’s family, appellate court affirmed summary judgment for the defendant.

It is not clear that the result would be the same had the case occurred in Massachusetts, as our courts tend to side with plaintiffs is many situations. Massachusetts, and Boston especially, is no stranger to cases involving people injured or killed by supposedly non-lethal or less lethal weapons. Many will recall the 18-year-old Emerson student who was killed during a celebration following the Patriots Super Bowl. In this incident, a paintball filled with pepper spray was allegedly fired at point black range, and it went through her eye, causing deadly brain damage.

This is a continuation of a post from last week where we discussed careers where retirement can be enjoyed longer and happier. In addition to nurses and teachers (analyzed previously), others include:

Military
Now this one may come as a bit of a surprise, given the highly stressful and life-threatening nature of the occupation. However, studies repeatedly indicate that military service members retire younger than their peers and receive some of the best lifelong benefits available to such young retirees. For instance, an enlisted soldier who joined at 18 is generally eligible to retire at just 38. With that retirement comes free enrollment in lifelong health benefits called CHAMPUS, a steady pension, and the ability to start a second career early in life.

Some retired service members choose to go into state or local government, such as police officers, postal employees, or other federal jobs. These individuals have the opportunity to "double-dip" by purchasing credits for their prior service. This means possibly getting two retirement checks by the time the rest of us get one. Beginning around 2000, the military began instituting a strong anti-smoking policy among the ranks. And while many soldiers, especially in combat arms occupations, still smoke, the rigorous physical training and strong policies favoring cessation programs make smoking much less prevalent than in previous years.

Moreover, the constant physical training leads to healthier lifestyles and better health outcomes. Obesity is practically nonexistent. Unfortunately, many service members are injured, suffer from combat or training related illnesses or medical conditions that make it necessary to leave before retirement. Thus, it may be difficult to paint a completely accurate portrait of lifelong health outcomes.

Farmers & Forestry Workers
This one is strange. Many do not think of farmers as having a career, because it is in many cases a family business, inherited from one generation and passed down through the family. The job, if one can call it that, is more or less a combination of thousands of jobs. Although large co-ops and international corporations have greatly changed the face of farming, those workers who still operate family farms are among some of the healthiest and happiest retirees. Although smoking rates among farmers are still around 30%, obesity is nil, and satisfaction is high. Perhaps it is something about seeing the fruits of one's labor (pun intended) or perhaps it is simply the amount of time spent outside, but farmers generally do not see themselves as retired. Even once they have done their last year, they still see themselves as a part of a small community for the rest of their lives.

Forestry workers are among the most smoke-free professions, with only about 2% self-reporting that they smoke. This is likely because smoking in state and national forests is strictly prohibited for workers. Likewise, obesity is rare, and overall job satisfaction is high.

I started my meditation practice back in February of 2014.

I blogged about the benefits I noticed after 3 months of doing meditation, but I want re-examine my perspective now—after 18 months of regular daily practice.

A regular meditation practice has had immense practical value in many ways. Here are some of the most powerful benefits I’ve noticed…

Clarity: I now have a persistent awareness of what’s most important to me, what’s less important, and what’s not important. I not only have better clarity about how things ARE, but also about how things are likely to unfold. (I’m not saying I can “predict the future,” but compared to the muddy thinking I was doing before I started meditating, that’s what it feels like).

Focus: I’m able to keep my attention locked in, without getting distracted. In today’s modern world there are many technologies that erode our attention (e.g. email and social media). I’ve put those technologies on a short leash.

Better thinking: my quality of thought has improved and useful ideas now come more easily, often without effort at all. When you’re trying to build a business you need lots of useful ideas, so this skill has incredible practical value.

Increased Self-Awareness: I’m now able to see myself (and my actions) with minimal distortion. This is key if you want to make positive changes in how you handle the challenges of life. This skill is directly connected to the next one…

Being less judgmental: I’m not as prone to judge myself as I examine what I’m thinking and doing. If you want to truly understand yourself it’s important to simply observe—i.e. examine without trying to correct any “flaws” you detect. Also, learning to let go of self-judgment makes me less inclined to judge others.

Better able to let go: I’m not as prone to being swept up by reflexive emotions or thought patterns now. We humans have a lot of “auto-pilot behaviors” that lead us into obsessions and conflicts that are pointless. I can more easily avoid those now.

Being more present: I’m way better at observing what is going on around me, and better able to listen to what people say. I’m less inclined to get distracted by thinking about what I want to say, and more able to hear what is being said with greater empathy.

More balanced: I’m not as easily disturbed. Even when people (who know me well) try to push my buttons I find myself able to sidestep their (usually unconscious) hostility. Or, if I do find myself starting to react harshly I tend to notice it sooner, which makes it possible to de-escalate more quickly.

So, those are some of the benefits I’ve noticed. But having talked about that let me turn to another thing that’s important to discuss.

Meditation “Myths”

Meditation is wonderful, but people who don’t do it tend to misunderstand how it works in the real world (i.e. not in a monastery). So, here’s the perspective of how a non-monk living in the busy modern world experiences the benefits of meditation…

Health-consciousness: I’m undoubtedly more health-conscious, but I’m not rigid or obsessive about it. I quit drinking completely for awhile (and enjoyed it), but went back to drinking wine in social situations. I’ve even drunk enough to have a hangover, but I recover quickly the next day. And don’t beat myself up for having made a poor decision the day before.

Calm, but not unflappable: I’m mostly calm now, and definitely calmer than I was 18 months ago. But I still get frustrated sometimes. When I become mentally unhinged I notice it more quickly now—sometimes even as it’s happening (which is weird, but obviously helpful).

More aware, but still selfish: I’m still influenced by my old patterns—the strongest of which is a tendency to be overly self-centered, or flat out selfish. What can I say? I’m better at noticing this, and better at correcting it, but I still have a long way to go and I’m working on it.

More spiritual: I now notice some kind of enhanced awareness of the world, which I suppose can best be described as “spiritual.” I have no desire to have this experience validated by other humans. I’ve noticed that many discussions of spirituality bleed into discussions of religion and that leads in a direction away from the “enhanced awareness” that I’m now starting to experience more often. So it’s probably best not to say anything more about it.

Less judgmental, but…I still tend to fall into the deep human tendency to gossip about others or criticize them in shallow ways. This is the thing I most want to curtail. Spending time gossiping is not only harmful to others (and yourself), it’s also unproductive and pointless.

Anyway, that’s my perspective after having spent 18 months meditating pretty much every single day.

When I started meditating I had this “concept” of what meditation was, and why it might be useful. Now I have experience, and specific results.

What is a meditation practice, exactly?

Now I’d say it’s the discipline of “awareness training.”

Being more aware, and thereby being less prone to unhealthy patterns of thought has some powerful benefits.

But only if you keep practicing…

Which is what I intend to do.
