Red Tape in Medicaid Applications
Medicaid is one of the most utilized government programs for elderly American citizens that are in need of medical assistance that they cannot afford. In order to qualify for the Medicaid program, an applicant must meet a number of criteria and an application can either be filled out online or in paper form. However, many applicants to the Medicaid program have run into issues of red tape and other problems when attempting to apply for benefits.
Online Medicaid Application
The online application for Medicaid can be found on the federal Medicaid program website. For seniors that are tech savvy, the online application can be filled out in about 45 minutes. The website contains all kinds of information like eligibility, benefits, and required documentation needed to be considered for the program. After an online application is submitted, there may be follow-up phone calls by the program to make sure that everything regarding their application is in order, but usually an accepted applicant can receive their benefits card within 45 days of submitting the online application.
Difficulties with Applying
One of the biggest issues regarding the online application for Medicaid is that many seniors are not comfortable enough with computers and technology to fill out the application online. This means that either errors are submitted on the online application, or elderly applicants face problems submitting a paper application to the program. One common complaint is that "a computer can't answer your questions, but a knowledgeable caseworker can." That is why some previous applicants to the Medicaid program encourage others to go in person to the Medicaid office to fill out their applications for coverage.
By filling out a Medicaid application in person at a local Medicaid office, the application can be completed with the help of a dedicated caseworker, the errors submitted are marginalized, and the delays on the application are greatly reduced. Unfortunately, some applicants have noted long wait times when many people go to the Medicaid office at the same time. It is important to plan accordingly if you wish to fill out an application in this manner. On average, a person waits about two hours before they are helped in person at a Medicaid office.
How to Get Help
There are many resources available to help Medicaid applicants with their issues on the application. Questions regarding the program can be answered at any local Medicaid office or Social Security office. You can also call in and ask a question about the application process, but typically callers are placed on hold before they can speak to someone about their problems.
Finally, you can get information regarding the Medicaid application process from a local hospital and hospital social worker. These employees will be able to offer access to the Medicaid application as well as answer any questions that an applicant may have about the process. Some hospitals outsource this job to specialized companies, and if your hospital does this then they can give you the information necessary to contact a specialist there.

According to a recent article from the WV Record, an injured customer is suing a major big box retailer for an alleged slip-and-fall accident resulting in personal injury.
This female plaintiff has alleged multiple negligence claims against defendant as being responsible for her slip-and-fall injury, which occurred in May of 2013 during a shopping trip to the store. In her complaint, plaintiff asserts she was in the pedestrian walkway of the store when the accident occurred. She further alleges defendant had breached its duty of care owed to her by allowing standing water to remain in the area designated for pedestrian traffic.
Plaintiff alleges during the fall, she suffered significant injury to both knees, one ankle, her back and her neck. She also challenges defendant’s explicit claims that it maintains and safe and hazard free environment for all shoppers. Her specific claims include allegations of standard negligence, gross negligence, negligent misrepresentation pertaining to the claims of providing a safe, hazard free environment, pain and suffering, and negligent infliction of emotional distress. The plaintiff has also filed claims for pre-judgment interest, post-judgment interest, attorney’s fees and court costs.
As our Boston slip and fall injury attorneys can explain, in the Commonwealth of Massachusetts, premises liability cases operate somewhat differently than they do in most other jurisdictions. In most jurisdictions, the courts adhere to a series of confusing common-law rules that distinguished the type of establishment or structure in which a plaintiff was injured and the person’s reasons for being at the scene of the accident. It can change the duty of care owed to a plaintiff if the plaintiff was a paying customer, season ticket holder at an arena or stadium, guest in someone’s home or even an “expected” trespasser.
However, in the 1970s, the Supreme Judicial Court (SJC) for the Commonwealth of Massachusetts, which is our state supreme court, decided to do away with these old and no longer relevant distinctions and created a “bright line” rule concerning the standard of care for premises liability negligence cases. As long as plaintiff is someone who is expected to be at defendant’s home or place of business, and not an unforeseeable trespasser, defendant owes the same standard of care as in any other typical negligence case.
In the Commonwealth of Massachusetts, it is first necessary to establish defendant owed a duty of care to plaintiff. While a duty of care can be created by statute (anyone with a driver’s license in a car crash case) or it can be created by a contractual relationship (a lifeguard with respect to a pool accident), not everyone has a duty of care to protect everyone else. However, a landowner does owe a duty of care to any foreseeable guests on his or her land.
In other words, if a landowner has reason to believe someone will enter his or her land, he has a duty to act as a reasonable and prudent person to prevent foreseeable injury to that person and his or her personal property. This can include making reasonable efforts to make sure the floor is dry at all times, and, when it is wet, placing warning signs telling customers to expect a wet floor.

“The Voice” Mutes Voices
NBC’s The Voice is in its eighth season, with few signs of letting up. So what are the pros and cons of being a contestant on the show? I talked to a couple of former participants – Emily Earle from Season 3 and Clara Hong from Season 7 – for their takes on the experience.
Both musicians agreed they got a positive bounce from the show. Not only did the national exposure provide a boost of self-confidence and dose of professional validity, it has also helped them get gigs. Emily says that in her adopted hometown of Nashville, she’s often recognized by a younger demographic than you might expect, and when she performs at the Opry Mall (hey! this is Nashville) it’s often younger kids that hang out to listen. Clara’s experience has been similar, and includes getting messaged by young people looking for career advice. And because both women were in the crucible of a national TV show and very much in the public eye, it’s perhaps a bit easier to meet people. Plus, they got to meet and know many really good musicians.
Clara learned that in popular entertainment, like The Voice or American Idol, image is everything, and don’t think it’s not. But for Clara, who is Asian, the beauty team was not experienced in doing makeup for Asian women. Her makeup artist said to her, “You don’t have a crease in your eye, so we want to put one in.” Clara stood up for herself and went to the ‘show mom,’ who was kind and supportive, and ultimately got her wishes honored. But Clara is still left with the sneaking sense that because she complained, the powers-that-be wanted her off the show. And perhaps, just maybe, the overall results were “pre-decided.”
For both musicians, maybe the greatest downside was the non-compete agreement they had to sign, which restricted their creative efforts during the show and for a six-month period following the last airing. In effect, their careers had to sit on the sidelines for nine months when they had the most buzz from their network appearances.
Clara’s advice to the teenage girl wanting to be on the show: if you want to be famous, go for it. But if you want to do your art on your own terms, ask yourself whether you can afford to effectively spend six months with your professional hands tied? Sure, the winners will get a recording contract, but everyone else goes home to wait out the non-compete period (although some former contestants, each confided, skirted these contractual prohibitions and continued to pursue their careers).
Emily wishes she’d had a CD out at the time – everyone else she knows from the show who had a current CD got a big bump in sales. Emily says that generally those who do not win the contest cannot get signed to a record deal. And in any case, since labels are looking to sign artists in their mid-20s, for a young artist, losing many months to the show’s non-compete agreement can seem like a lifetime.
What’s more, the show owns a significant piece of the publishing of any compositions written by the contestant during the show’s run, and since the contestant gets no benefit from original songs (because original songs are not performed on the show), the musician has to decide whether to put her songwriting on hold, or share publishing with NBC. Of course, The Voice would argue that the exposure provided by the show is a significant factor in any success the artist may achieve from a composition written during that time, so they’re entitled to a piece of the publishing.
With wisdom beyond her years, Clara recognized that not every opportunity is a great one, so seize them carefully and never compromise anything.

Alan Dershowitz Sues Boston Arena for Slip-and-Fall Injury
Boston Attorney and Harvard Law professor Alan Dershowitz, best known for his role on the O.J. Simpson defense team during the world-famous murder trial, is making headlines once again. This time, according to a recent news article from The Boston Globe, Dershowitz is suing the TD Boston Garden arena where the Boston Bruins and Boston Celtics play for alleged negligence involving a slip and fall accident.
Through his complaint, Dershowitz alleges he was at the arena while attending a Boston Celtics game nearly three years ago. While at the arena, he went to use one of the bathrooms in the facility and slipped on an allegedly wet floor near the sinks and fell to the ground, injuring himself. He is blaming the hazardous condition of the floors on the arena operator’s failure to adequately supply the bathroom with paper towels.
His complaint further alleged that the potentially thousands of men who used the bathroom in the roughly 60 minutes prior to his fall had washed their hands and had no paper towels available on which to dry them. As a result of having no paper towels, these men had to allow the water to drip off onto the bathroom floor or to “shake” the water off onto the floor, causing it to be wet and, therefore, hazardous to people walking in the bathroom. The author of the article attempted to contact a spokesperson from arena management, but they declined to make any comment, due to ongoing litigation regarding the matter.
Court records indicate Dershowitz slipped on the allegedly wet bathroom floor, causing him to fall violently to the hard surface at the time of his personal injury. During this slip and fall, Dershowitz alleges he twisted awkwardly and suffered a personal injury to his right knee, leg, and his back. He is currently 76-years-old and has held season tickets for the Boston Celtics since 1965.
Dershowitz said he filed the lawsuit because the statute of limitations was about to expire, and he had been unable to negotiate an acceptable settlement with the area or its liability insurance company. He said he is personally unaware of the state of negotiations, because he hired a former law student to handle the matter in Suffolk Superior Court.

Florida Rejects Medicaid Expansion
The Florida House of Representatives rejected an expansion of the state's current Medicaid system that leaves hundreds of thousands of people caught in the state's coverage gap. This gap applies to people living in the state who make too much money to apply for coverage but too little to cover the costs of their medical care. It has the possibility of having a serious effect on elderly people who live down in Florida full-time or have made it their primary residence for Medicaid eligibility purposes.
Florida Medicaid Program
Florida currently has 1.3 million people enrolled in the federal exchange for healthcare insurance, more than any other state in the country. Most of these people qualify for subsidies, but if these subsidies were invalidated then they would lose their access to coverage. This is of particular concern now as the U.S. Supreme Court is currently ruling on the case of King v. Burwell, which will determine whether federal tax subsidies that allow for low and middle income people to purchase insurance through the marketplace will be unconstitutional.
Proposed Medicaid Expansion
The proposed Medicaid expansion would raise the income limits for eligibility, and one hundred percent of the cost of coverage would be covered by the federal government through 2016, with ninety percent coverage by the government after that. Without the expansion, around 700,000 people remain in Medicaid's coverage gap. Furthermore, it has driven many in Florida out of the marketplace altogether with 24% of its population completely uninsured, the second highest uninsured rate in the nation.
One advocate of the proposed Medicaid expansion in Florida said, "If the Medicaid dollars [were] accepted, in combination with the exchange, you'd pretty much have a path to coverage for everybody. People [would be] able to get primary preventative care and ultimately [wouldn't] have to bankrupt themselves to access coverage, as happens to many in Florida."
Effects on Florida Citizens
The downsides of rejecting the Medicaid expansion affect many in Florida, young and old. In regards to children, one researcher found that 28% of the population under consideration for Medicaid in Florida are parents, so their rejection affects their children, too. "When parents are covered, it improves the financial security of the family. It also improves the health of the parents, which reduces conditions like maternal depression."
Furthermore, it reduces the percentage of children that are uninsured across the state. "Florida has a very poor enrollment rate in the Medicaid and CHIP programs, and that's why Florida has the highest uninsured rate of kids in the South." Studies have found that when the entire family is covered by programs like Medicaid, enrollment has improved.
The lack of Medicaid expansion also affects the elderly in Florida. Many seniors across the state are living on a fixed income or may be close to outliving their funds. However, these seniors are still caught in the middle of the coverage gap and are unable to qualify for Medicaid. This means that they must spend down their assets and leave nothing for their loved ones or go without Medicaid coverage for their healthcare needs.

CVS Investing Big in Elder Care
CVS Health Corp. CEO Larry Melo recently announced that the company is investing billions into the purchase of a nursing home pharmacy operator in an attempt to transform into a dominant healthcare player for senior needs. CVS purchased the company Omnicare, Inc. in its bid to outgrow CVS' drugstore chain persona into something more all-encompassing for healthcare needs and focus more on the growing population of aging seniors in this country.
Recent Changes to CVS
This is not the first major change that CVS has made to its healthcare focus in recent years. In 2011, the company announced that it will no longer be selling cigarettes in its mission to improve its consumers' health. It also changed its name from CVS Health to CVS Caremark and aggressively expanded the number of in-store health clinics. By 2017, CVS aims to have another 600 in-store health clinics for consumers and in 2013 the company purchased a drug-infusion company to expand its healthcare competencies.
Purchase of Omnicare, Inc.
The purchase of Omnicare, Inc. cost CVS $12.7 billion including debt. It is by far one of the largest and most aggressive moves that CVS has made into becoming a major healthcare provider. The company expects that the purchase of Omnicare will add adjusted earnings of twenty cents per share to its stock in the next year. The only other deal that is comparable to the purchase of Omnicare was CVS' purchase of Caremark Rx, Inc. in 2007 for $21.7 billion.
The purpose of these major changes is to "move away from being solely a pharmacy and PBM to becoming more of a vertical integrator of health care," focusing primarily on an aging population with greater care needs. Omnicare provides medications and helps nursing home facilities manage their residents' medications. CVS hopes to use this platform to move its care services towards more long-term care needs and assisted-living operations.
Growth of CVS Healthcare
The pharmacy unit for CVS is by far the company's largest driver of growth, with revenues increasing by 18.2% in that sector last year. The demand for pharmacy and medications continues to grow as more patients and medical professionals look to manage the costs of medications in a time of soaring drug prices. With the purchase of Omnicare and other vertical companies in the drug supply chain, CVS is poised to provide quality medications to seniors and other patients at a lower price.
Currently, CVS is the nation's largest provider of prescription drugs and the second largest pharmacy benefits manager in the United States. The company handles health plans for insurers and employers alike. In total, CVS operates 7,700 retail pharmacies, 900 walk-in clinics, and manages the pharmacy benefits of over 65 million people across the country. With the purchase of Omnicare, CVS hopes to increase the number of consumers cared for by millions as more seniors are in need of long-term care and medication.

While hunting is a popular activity across New England, including parts of Massachusetts, there is obviously some degree of danger associated with the outdoor activity. Not only are you relying on the members of your own hunting party to act in a responsible manner, you may also have to contend with potentially negligent hunters in other groups sharing the woods with you. Sometimes their actions can result in serious personal injury or death.
While being shot is one obvious danger, there is a wide variety of equipment many hunters use that can also be dangerous, ranging from tree stands for deer and bear hunters to boats utilized by many duck and other waterfowl hunters. According to a report form The Taunton Gazette, two hunters died when their camouflaged johnboat capsized into frigid water.
Authorities say their investigation has revealed that three hunters were in the johnboat during the winter months last year while hunting for ducks. Both men were considered avid duck hunters and had used the 16-foot metal skiff in the same body of water many times.
One local resident saw the metal boat floating upside down in the choppy water of the nearly frozen river and immediately called 911. First responders arrived with water rescue equipment, including cold-water dive suits. They first found the boat tangled in mooring lines and located the trailer at the boat ramp they believed was used to haul the boat to the river.
While emergency crews looked for any survivors, other officers went to the victim’s home, which they were able to locate from the motor vehicle information, and learned that three men had left to go hunting early that morning.
Back at the scene of the deadly boat accident, divers found the bodies of two of the accident victims, and the United States Coast Guard sent a Jayhawk helicopter up and down the river to locate the third victim, whose body was not found in the capsized boat. They eventually located the man, who was suffering from hypothermia, on a small island and transported him to a local level-one trauma center, where was treated and survived the horrific ordeal.
